Terms & Conditions

These Terms & Conditions (“Terms”) govern the relationship between Berard Travels and Tiffany’s Treasured Travels (collectively, the “Agency,” “we,” “our”) and you (“Client,” “Traveler,” “you,” “your”). By requesting travel planning, approving an itinerary, authorizing payment, or traveling on any itinerary arranged by Agency, you agree to these Terms on behalf of yourself and all travelers on the same booking.
 

1) Eligibility & Accurate Information

You confirm that you are at least 18 years old and have the legal authority to enter into this agreement and authorize travel purchases.

You agree that all information you provide (names, dates of birth, passport details, contact info, loyalty numbers, etc.) is true and accurate. You are financially responsible for all travel booked through Agency, including travel booked for others in your party.
 

2) Our Role as Booking Agent

Agency provides travel planning and booking services and acts solely as a booking agent for independent third-party travel suppliers (“Suppliers”), which may include airlines, cruise lines, hotels, resorts, tour operators, transportation providers, and activity/excursion operators.

Suppliers are independent entities with their own terms, conditions, and policies. Your travel documentation will identify the Suppliers responsible for providing your travel services. By booking, you agree to comply with Supplier rules, restrictions, and policies.
 

3) Offers, Pricing Errors & Availability

All offers, promotions, and Supplier incentives are subject to availability and may change without notice. Pricing is not guaranteed until confirmed by Supplier and paid in accordance with Supplier requirements.

We reserve the right to correct errors or omissions (including pricing) and will notify you if a correction materially affects your booking.
 

4) Payments, Deposits & Final Balances

You authorize Agency to charge your approved payment method for deposits, final payments, fees, and other charges associated with your travel booking.

Failure to pay by due dates may result in Supplier cancellation and the loss of deposits or payments already made. You are responsible for Supplier price increases, penalties, or fees caused by late payment.

Currency & bank fees: Foreign transactions and currency conversion may result in additional fees charged by banks or Suppliers. Agency is not responsible for these charges.
 

5) Changes & Cancellations

All changes and cancellations are governed by Supplier policies. Supplier penalties may include partial or full forfeiture of funds. Some bookings are non-refundable and non-changeable.

All change or cancellation requests must be submitted to Agency in writing.

Agency fees: Any planning, concierge, or professional service fees charged by Agency are non-refundable once work has begun, unless otherwise stated in writing.
 

6) No Shows & Unused Services

Failure to check in, board, or appear for any portion of travel (“no show”) may result in cancellation of remaining services and forfeiture of all funds, per Supplier policy. No refunds are provided for unused portions of travel unless the Supplier expressly allows it.
 

7) Travel Documents & Name Accuracy (Important)

Travelers are responsible for obtaining and carrying valid passports, visas, and any documents required by law or Supplier policy.

Names on reservations must exactly match government-issued identification. Agency is not responsible for denied boarding/entry due to incorrect or mismatched information.

Document review: When you receive confirmations/tickets, you must review them immediately for accuracy and notify Agency of any needed corrections within 24 hours. After 24 hours, you may be responsible for Supplier change fees or additional costs.
 

8) Independent Arrangements Not Booked Through Agency

Agency is not responsible for travel arrangements you make independently (including flights, hotels, transfers, excursions, or travel protection not booked through Agency). If you book your own flights, Agency cannot be liable for schedule changes, delays, missed connections, or Supplier disruptions affecting independently-booked travel.
 

9) Tours, Activities & Excursions

Tours, activities, and excursions are often provided by independent operators. Operators may cancel, change, or deny participation at their discretion. Excursions may operate rain or shine unless the Operator cancels.

Participation in excursions and activities involves inherent risks. Travelers assume full responsibility for choosing to participate.
 

10) Travel Risks, Health & Safety

Travel may involve risks including illness, injury, delays, weather events, civil unrest, government restrictions, and other circumstances beyond anyone’s control. You are responsible for reviewing current guidance and requirements for destinations and Suppliers (including entry rules, health requirements, and advisories).
 

11) Travel Insurance

Agency strongly recommends comprehensive travel insurance, including medical and cancellation coverage. If you decline travel insurance, you assume all financial responsibility for losses due to cancellations, delays, medical costs, supplier insolvency, or other disruptions.

Agency is not an insurance broker and cannot guarantee claim outcomes with any insurer.

12) Limitation of Liability & Supplier Responsibility

Agency is not liable for any loss, damage, injury, death, delay, inconvenience, or expense caused by Suppliers or third parties, including their negligence, errors, omissions, schedule changes, cancellations, overbooking, service failures, or insolvency/bankruptcy.

To the maximum extent permitted by law, if Agency is found liable for any reason, damages are limited to the amount of Agency service fees and/or commissions actually received for the booking at issue.
 

13) Chargebacks & Disputes

Refunds and credits are governed by Supplier policies. You agree not to initiate a chargeback or payment dispute to avoid Supplier or Agency cancellation terms, except in cases of fraud. Unauthorized chargebacks may result in additional fees, collection efforts, and recovery of costs (including reasonable legal fees) where permitted by law.
 

14) Force Majeure

Agency is not responsible for delays, cancellations, or service changes due to events beyond our control, including acts of God, severe weather, natural disasters, war, terrorism, strikes, pandemics/epidemics, quarantines, government actions, or supplier shutdowns.
 

15) Traveler Conduct

Travelers are responsible for their conduct and for any damage or loss they cause. Suppliers may refuse service or remove travelers for disruptive or unsafe behavior without refund. Travelers are responsible for all resulting costs.
 

16) Updates to These Terms

We may update these Terms at any time. The version posted on our website is the current effective version. Continued use of Agency services constitutes acceptance of the updated Terms.
 

17) Governing Law

These Terms are governed by the laws of the state in which Berard Travels is registered.
